The importance of this thesis is to find a solution to the archaic & out dated common law doctrines which have plagued our jurisprudence for long since the inception of common law in Uganda in 1889. Secondly, the thesis also explores one of the modes of Succession (Intestate Succession) & the effect the right of survivorship bears upon it. The land tenure systems under investigation are mailo, customary & freehold. This thesis is geared towards assessing how the latter changes in land tenure have & will affect women’s rights to own property then, now & in the future. This particular district & town was once a war torn area & a place where numerous changes in land ownership & tenures also took place. ![]() ![]() This thesis paper is a hybrid research which centers on how the right to survivorship under joint tenancy affects women during intestate succession in “Semutto” town “Luwero” district. Women have from time in memorial been considered to be amongst the marginalized groups in society & are accorded special status under the Constitution.
